Terms & Conditions

1. Introduction: Before confirming your order please:

Read through these terms and conditions (the 'Conditions') and in particular our cancellations and returns policy and limitation of our liability and your indemnity.

By ordering from us, you agree to be legally bound by these Conditions. You will be unable to proceed with your purchase if you do not accept these terms and conditions as may be modified or amended and posted on this Website from time to time.

We reserve the right to revise and amend the Website, our disclaimers and the Conditions at any time without notice to you. Your continued use of the Website (or any part thereof) following a change shall be deemed to be your acceptance of such change. It is your responsibility to check regularly to determine whether we have changed these Conditions.


2. About Us. This Website is owned and operated by Gardners Bakery Ltd ('we'/'us'/'our'), a limited company (trading as Gardners Bakery), registered in England and Wales. Our registered office is at 85 Harborough Road, Kingsthorpe, Northampton, NN2 7SL. Our business address is 85 Harborough Road, Kingsthorpe, Northampton, NN2 7SL, Gardnersbakery.co.uk, 01604 458555.


3.1 Ordering Process. You can place an order over the phone, by email or by coming into our shop. A 50% deposit is required to confirm your order. Without a deposit, there is no order placed. You can pay over the phone with a debit/credit card or by coming into the shop to pay with a card or cash. You can also order some designs online at Gardnerscakes.co.uk, full payment is required.

3.2 You can choose a design from our website or create your own. Please give as much detail as possible at time of ordering. Please be aware that whilst we can take inspiration from specific designs, every cake maker has a different style and therefore designs will not be able to be replicated exactly.

3.3 Whilst every effort has been made to take accurate photos and descriptions, colours may vary due to monitor/phone screens and all of our icing models may not be exact, due to the fact they are handmade. Whilst we do make handmade models, you can send us a photo of the person for inspiration however they are not intended to be exact replicas.

3.4 For wedding cakes, please book a consultation with Helen to discuss your requirements as we cannot guarantee that someone will be available at all times in store or over the phone, especially during busy Summer months. Consultations are free of charge.

3.5 Changes can be made once an order has been placed however it may not always be possible. Please give us as much notice as possible.


4. Collection/Storage. Cakes can be collected on the day they have been ordered for, from the shop front. If you're in a rush, we recommend phoning in advance to check your cake is ready as sometimes there may be delays out of our control and at busy periods.

4.2 The responsibility of the cake transfers to you upon collection of the cake.
Cakes must be handled carefully and placed in a safe place, on a flat surface. You must put the cake in the boot or foot well of the car when travelling and NOT on car seats or a persons lap. You must drive very carefully when transporting a cake, especially around corners and roundabouts. Cakes need to be kept flat as if not, this can cause them to slide.

4.3 You must not stack cake boxes or push the sides of the box inwards. Cakes with icing models on should be handled with extra care and attention as they are very fragile.

4.4 Do not refrigerate your cake, this will dry out the sponge and ruin decorations. Cakes must be kept in a cool, dark place in the box. Do not leave your cake in the car or garage overnight where the temperate is not consistent.

4.5 Cakes last up to five days if kept correctly. Wrap your cake in tin foil or cling film and place in an airtight container to keep it as fresh as possible.
Cupcakes, giant cookies & gluten free sponges are best eaten on the day of or the day after collection.

4.6 We may use supports and other non-edible items including polystyrene on your cake to attach models and other parts. Please remove these before serving and eating.


5. Faults/Complaints. We will make every effort possible to ensure your cake exceeds your expectations. However, in some instances the finished product may differ slightly due to the fact that each cake is individually hand made. At all times we will endeavor to delight you with our quality of products and services.

5.2 When collecting the cake, please make sure you are happy with the decorations and let us know if there are any issues, we will try our best to resolve them where possible. If collecting on behalf of someone else, please make sure they are happy with it also. By leaving our store, you are agreeing you are happy with the item collected.

This being said, If you would like to make a complaint or have a problem with a cake, please contact the store as soon as possible. You can message us on Facebook if it is out of shop hours. Corrections and repairs to cakes can be corrected on the same day in most cases, please make sure you collect your cake during our collection hours to ensure there are staff working who can do this. You are required to give us this opportunity and MUST let us know of the PROBLEM within ONE HOUR of ACCEPTING your cake.

5.3 We may need you to return the cake in order to fairly assess the situation and an immediate refund, or any refund, may not always be possible. Cakes, or parts of cakes, must be returned within two days of collection in order for us to investigate the nature of the complaint. A full refund may not always be possible and the maximum we offer is the full value of the cake (excluding delivery charge). We do not offer further compensation.

5.3 We will not be responsible for any faults where the cake has been placed in an unsuitable place or handled without care and attention.


6. Orders/Refunds. In the event of a pandemic, with another local or national lockdown forcing us to close, we will postpone all cake orders or issue credit to be used towards future cakes. We do not offer refunds.

6.1 Once you have placed and paid for your order, if you would like to cancel, please call or email us.
Cancelled orders are subject to the following fees:
-Over 14 days prior to collection date: 20% cancellation fee or postpone.
-14 days-7 days: 50% cancellation fee or postponing may be an option.
-Less than 7 days:  NO refund and unlikely chance of postponing.
Any work already completed may be charged on top of these fees.
These fees are for cakes ordered in person or over the phone, online orders have a separate cancellation policy. 

Please note that all cancellation fees are applied at the sole discretion of management. While we strive to be fair in the event of genuine emergencies or unforeseen circumstances, we reserve the right to enforce the full cancellation charge as outlined above to cover lost time and resources, and potential turned down orders.

6.2 If you need to cancel a wedding cake order, please email or call Helen. You may not be entitled to a refund if we are fully booked for the date of your wedding as we may have had to turn down orders at busy periods. We require a 50% non-refundable deposit when ordering and any extra work already completed will be charged. There will be no refunds for any further deposit paid if the wedding is less than 2 months away at the time of cancelling.

We will try our best to help, whether that is changing the design/size, or postponing your order, however this may not always be possible. Deposits paid when ordering are non-refundable (including 'save the dates') and cannot be redeemed as credit.

We understand that life happens. While our standard cancellation policy applies to all bookings, we reserve the right to review and adjust fees on a case-by-case basis at our discretion. Decisions made by management regarding fee waivers are final.

6.3 We will need to process your refund by the payment method you used to order the cake. The same card must be used and it may be possible that you have to physically come into the store in order to confirm identity.

 

7. Printing of photos onto cookies & copyright. We use edible ink and edible sheets of paper to print our photos, therefore quality and colours may deteriorate during this process. We advise that you provide us with as high a quality image as possible.

    7.2 Images with very fine or small writing can often be a challenge to print clearly, therefore where possible, please send images with larger, bold text or alternatively remove the text to simplify the print. We also advise that text is large, bold and a solid colour rather than pastel or lighter shades.

    7.3 We may occasionally suggest an image is re-designed in order that is can be printed within the parameters of our equipment. Where the re-design request or our ideas are not accepted, we will not provide any refunds should there be any image quality issues.

    7.4 Copyright You must only supply us with images that you own the copyright for, or which you are authorised to supply to us by the copyright owner. You warrant that the images you supply do not contain anything which would infringe any copyright, trade mark, design right or other intellectual property right of any third party. We will not check the content of any images provided by you. It is the customers’ responsibility to ensure that any material supplied in any medium is not protected by copyright law, or that necessary permission for Gardners Bakery Ltd to reproduce such images has been obtained.

    7.5 Images supplied to us remain under the existing copyright. By supplying us with an image you are granting us a licence to modify, print, or otherwise use the image in accordance with the details of your order. By placing an order and accepting these terms you are accepting any and all liability for any consequences of Gardners Bakery Ltd using the images you supply.

    7.6 We may photograph products that we provide to you, including those decorated with a logo or other artwork supplied by you. We may display these photographs on our website or other advertising media, unless specifically requested by you not to do so.

    7.7 You must not supply us any images or any other material, or any content within such images, which contain any threatening, defamatory, blasphemous or pornographic material, or show any kind of child abuse, or are racially offensive or abusive of any religion, or likely to incite hatred against any person or group, or are otherwise criminal or offensive in the minds of reasonable people, or are obscene or menacing or harassing in any way, or breach any applicable law.


    8. Allergens/Ingredients Our cakes contain dairy, gluten (wheat), eggs, soya, sulphites and other allergens. Details of allergens are available on request. Although most of our cakes do not contain nuts, they are in an environment that handles nuts. Egg-free, Dairy-free and gluten-free cakes can be made on request. We cannot guarantee that cakes will not contain trace amounts of these ingredients as they are all made in the bakery which handles ingredients with these allergens, they are free-from recipes only.

    8.2 Gardners Bakery Ltd accepts no liability for customers suffering allergic reactions from eating our cakes. It is the responsibility of the customer to make sure we are aware of any special dietary requirements.


    9.1 Hire of Equipment. Cupcake and cake stands are available to hire on request. We only have a limited amount so please check far in advance that we have one available for the date of your celebration. All equipment must be collected and returned by the customer (unless the cake is being provided and delivered by us - it is your responsibility to return but we will deliver). Hire charge can be paid by debit/credit card or cash and must be paid in advance.

    9.2 The hire charge taken upon booking for cake stands starts from £10.00. A £100 deposit is due the week of the hire and is refunded upon satisfactory return of the item, you can either leave us card details with your permission or cash.

    9.3 The hire charge rate is for a period of four days (i.e. collect Friday and return Tuesday). A charge will be made for late return (£3.50 per day) and forfeiture of the deposit if not returned within 10 days or after the arranged return date. Collection and return times can be varied by individual arrangement to suit the customer only if agreed in advance of hire.

    9.4 Damage or loss of equipment (or any part thereof) will result in forfeiture of the deposit and may lead to additional charges if this is insufficient to replace the item. Prices may be subject to change depending on supply cost changes, but these will be notified in advance.

    We reserve the right to review and adjust fees on a case-by-case basis at our discretion.

     

    10.1 Errors & Omissions: While we strive to ensure all information on our website is accurate, errors may occasionally occur. In the unlikely event that a product’s price, description, or specification has been incorrectly advertised, we are under no obligation to fulfill or provide those goods at the incorrect rate.

    10.2 Right to Modify: We reserve the right to update or change the website domain, service offerings, product range, prices, and specifications at any time without prior notice. All products are subject to availability.

    10.3 Pricing Corrections: If you place an order and we subsequently discover a pricing error, we will contact you as soon as possible to discuss your options. These may include paying the correct balance, selecting an alternative product, or receiving a full refund and cancelling your order. We reserve the right to cancel any order influenced by a technical or human pricing error.

    10.4 Substitution & Availability: In the event that a specific decorative item (e.g., a particular figurine, topper, or candle) is out of stock or no longer available, we will contact you to discuss an alternative design. While we aim to match your vision as closely as possible, we reserve the right to make professional substitutions that maintain the quality and aesthetic of your cake.



    11. Governing Law & Jurisdiction. The Website is controlled and operated in the United Kingdom.

    These terms and conditions are governed by the laws of England and Wales and you agree to submit to the exclusive jurisdiction of the courts of England and Wales.

    These terms and conditions do not affect your statutory rights.

     

    12.1. In-Store Surveillance

    For the safety of our staff and customers, and for the prevention and detection of crime, we operate 24/7 CCTV surveillance throughout our Northampton premises. This system captures both video and audio, which may include any conversations held within the store or over the phone while on the premises.

    12.2 Recording & Use of Content

    By entering our store or contacting us via telephone, you acknowledge and consent to the electronic recording of all conversations. Use as Evidence: These recordings and transcripts may be used as evidence in connection with any dispute, legal proceeding, or court case. Third-Party Disclosure: We reserve the right to share, transfer, or disclose any recorded content (audio or video) to third parties - including but not limited to legal counsel, law enforcement, insurance providers, or relevant authorities - at our sole discretion for the purposes of safety, legal compliance, or dispute resolution.

    12.3. Customer Recording Policy

    We strictly protect the privacy and safety of our team: No Unauthorised Recording: Customers are not permitted to record video or audio of our staff members without express permission. Mandatory Disclosure: If you intend to record a conversation, you must disclose this at the very start. Right to Refuse: Our staff reserve the right to decline being recorded or to terminate an interaction if an unauthorised recording is taking place.

    We reserve the right to modify these at any time, so please review it frequently. Changes and clarifications will take effect immediately upon posting on our website.
